1. GENERAL PROVISIONS

1.1. This Regulation specifies the procedure for implementing the International social project for children “NOOSPHERE BIRTHDAY CARDS” (hereafter – the “Project”).

1.2. The Project Organizer: NON-GOVERNMENTAL ORGANIZATION “ASSOCIATION NOOSPHERE” (hereinafter – the “Organizer”).

The Project may be organized/implemented by the Organizer in partnership with other legal entities (sponsors, partners, etc.) based on the agreements/contracts concluded or without them.

1.3. Aiming to carry out necessary preparations and implement the Project, the Organizing Committee of the Project (hereinafter – the “Organizing Committee”) is established by the Organizer’s decision, and it is entitled to solve administrative and organizational issues as a part of/within the limits of organizing and implementing the Project, and it is accountable to the Organizer.

The Organizing Committee may include the members of NGO “ASSOCIATION NOOSPHERE” (the Organizer), the authorized representatives of the Organizer and other persons involved, who, by the Organizer’s decision, have sufficient administrative and organizational skills.

The Organizer is entitled, at any time, to terminate the powers of the Organizing Committee, form a new membership of the Organizing Committee and/or independently implement the Project.

1.4. Project goal and objective: to encourage children from around the world to take part in exchange of support between each other, in particular to motivate children and adolescents to the creative activity in the space sector through painting.

1.5. The artistic works – works of visual art (hereafter – the “Works”) which depict the topic of the Project that is defined by the decision of the Organizer/Organizing Committee, are accepted as a part of the Project.

The topic of the Project is published on the Organizer’s online resources and/or other advertising/information materials on the Project prior to its commencement.

The Works submitted for the Project may depict real or fantastic events, space phenomena, childhood fantasies about interplanetary missions, extraterrestrial civilizations, unexplored planets, and the Works may also be dedicated to memorable dates in space history, remarkable astronomical discoveries, stellar astronomy, etc. in accordance with the defined topic of the Project. The Participants may also write welcome text/wishes to the other Participant.

1.6. All interested children and adolescents from all regions of Ukraine and various countries of the world (except for the russian federation and the republic of belarus), who are willing to share their kindness and support with other Project participants as well as to unleash their creative abilities, are invited to participate in the Project.

1.7. Stages and timelines of the Project:

– announcement of the Project (during the entire implementation period of the Project);

– registration of Project Participants (including the processing of Participants’ applications);

– e-mailing of welcome letters to the Project Participants attached with the Work of another Participant;

The timelines of the Project are defined by the Organizing Committee with the approval of the Organizer and published on the Organizer’s online resources and/or other advertising/information materials on the Project prior to its commencement.

1.8. This Regulation is elaborated in accordance with the norms and regulations of the acting legislation of Ukraine, statutory and local documents of the Organizer.

2. PROJECT PARTICIPANTS

2.1. Children and adolescents (young and minors) aged from 3 (three) to 17 (seventeen) years inclusive from all regions of Ukraine and various countries of the world (except for the russian federation and the republic of belarus) are invited to participate in the Project.

2.2. In order to participate in the Project, while registering, the Participant shall perform the actions stipulated by the clause 2.3. (and its constituents) of this Regulation, within the time frame of the registration defined by the Organizing Committee**.

**Provided that, if the Participant is under the age of 14 and is not entitled to independently exercise the rights to the results of his/her own intellectual activity, the registration of this Participant shall be carried out by the Participant’s legitimate representatives**.

The registration of this Participant may also be carried out by Teacher/Methodologist (of art studio, school, group, etc.) with mandatory consent of the Participant’s Legitimate Representatives to the participation of this Participant in the Project and compliance with this Regulation.

In any case, the Participant’s Legitimate Representatives shall give their consent to photo and video recording of the Project Participants, in particular when they meet with the Organizer/Organizing Committee and to the use of these graphic (photo and video) materials at the Organizer’s own discretion as well as to processing, storage and use of the Personal Data, provided by the Participant, in compliance with the Law of Ukraine “On Personal Data Protection”.

**Within the territories, stipulated by the Laws of Ukraine “On ensuring the rights and freedoms of citizens and legal regime in the temporarily occupied territory of Ukraine” and “On the peculiarities of state policy on ensuring state sovereignty of Ukraine over temporarily occupied territories in Donetsk and Luhansk regions” and other related laws and regulations.

2.3. In order to register, the Participant needs to follow the steps below:

2.3.1. When registering for the project it is necessary:

1) To register by filling in the Application (application form) for participation in the Project in the format specified on the Project website: https://noospherespace.art/.

2) To specify (confirm) in the Application (application form) and/or in a specific place/field on the Project website: https://noospherespace.art/ that:

“The Participant and/or the persons stipulated by the clause 2.2 of the Regulation – Parents/Legitimate Representatives of the Participant, Teacher/Methodologist of the Participant:

– have read and understood this Regulation and have agreed to comply with it;

– give their consent to the transfer of all exclusive proprietary copyrights to the Work (work of visual art of the Participant) to the Organizer, including, but not limited to, the use of this Work of the Participant towards meeting the program goals of the Project, dissemination and publication of these Works to scale up the Project outreach, the use (including alteration), storage and transfer of the Participant’s Work by the Organizer in cooperation with potential partners and sponsors of the Project, and/or the use of the Work by the Organizer at his/her own discretion in compliance with his/her statutory activities;

– give their consent to photo and video recording of the Project Participants, in particular when they meet with the Organizer/Organizing Committee as well as to the use of these graphic (photo and video) materials at the Organizer’s own discretion;

– give their consent to the disclosure of the Participant’s (Participants’) name, age and other information in the Work and its copies, and in any public use of the Work, whenever practicable;

– give their consent to processing, storage and use of the Personal Data, provided by them, in compliance with the Law of Ukraine “On Personal Data Protection”.

If, taking into consideration technical conditions/capabilities of the Organizer/Organizing Committee, it is necessary to specify (confirm) in the Application (application form) or if, when registering, it is required to specify (confirm) in a specific place/field that “I have read and understood, and have agreed with this Regulation”, or any other similar statement, this clause shall automatically imply the content of the clause 2.3 of the section 2 of this Regulation.

3) To download and send the image (scanned copy, photo, digital version, etc.) of the Work performed by this Participant to the Project e-mail.

2.3.2. Registration procedure for the participation in the Project:

Taking into consideration technical, organizational (including those related to the scale/complexity of the Project) conditions and capabilities of the Organizer/Organizing Committee regarding implementation of the Project, the Organizing Committee may take the following decisions:

1) to carry out the registration of the Participant to take part in the Project according to the procedure stipulated by the clause 2.3.1 of the Regulation;

2) to simplify the registration of the Participant by regulating the registration procedure and providing the list of certain implicative actions (for example, sending an e-mail with the Participant’s data and Work to the Organizing Committee and/or filling in the registration form with further downloading of files from the Project website, or implementing other actions aimed to participate in the Project) to be carried out by the Participants (with the consent of the Participant’s Legitimate Representative) in order to carry out and confirm the registration of their participation in the Project.

3) The Organizing Committee is entitled to independently register the Participant with prior consent given by his/her Parents/Legitimate Representatives, provided that they submit the data required for the registration stipulated by the Regulation on the Project.

2.4. By participating in the Project, the Participants and/or the persons stipulated by the clause 2.2 of the Regulation (including by sending scanned copy (photo, digital version) and emails attached and/or enclosed with the respective Work for the Project, by filling in respective registration forms, by further downloading of files from the Project website, etc.) agree and confirm that they:

– acknowledge and agree that all exclusive proprietary copyrights to the Work (work of visual art of the Participant) shall be transferred to the Organizer, including, but not limited to, the use of this Work of the Participant towards meeting program goals of the Project, dissemination and publication of these Works to scale up the Project outreach, the use (including amendment), storage and transfer of the Participant’s Work by the Organizer in cooperation with potential partners and sponsors of the Project, and/or at the Organizer’s own discretion;

– give unconditional and irrevocable consent to this Regulation, undertake to comply with it, acknowledge that they provided all approvals required for the Participant to take part in the Project and comply with the provisions/requirements of this Regulation, as well as the consent without time limit to photo and video recording of the Participants and use of these graphic materials by the Organizer at his/her own discretion;

– Parents/Legitimate Representatives of the Participant or the Participant who has reached the age of 14, or Teacher/Methodologist of the Participant confirm that the Work was truly performed personally by the Participant;

– confirm and agree that it is forbidden to submit for participation in the Project the Works (drawings, paintings, etc.) that were previously available to public and took part in any other Project as well as those which infringe the rights of the third parties and/or acting legislation of Ukraine;

– give their consent to the processing and storage of their own Personal Data in compliance with the Law of Ukraine “On Personal Data Protection”, and recognize it as obtained from open sources;

– give their consent to receiving welcome letters from other Participants and letters from the Organizer.

2.5. If Parents/Legal Representatives of the Participant and/or Teacher/Methodologist of the Participant, and/or personally the Participant who has reached the age of 14 disagree with the conditions stipulated by this Regulation, and/or Teacher/Methodologist of the Participant did not obtain the consent of the Participant’s Legitimate Representatives to the participation in the Project (including compliance with this Regulation) or did not obtain any other consents stipulated by this Regulation, the Organizer/Organizing Committee recommends to terminate further actions aimed at the registration and/or participation in the Project.

By carrying out the registration and/or further sending the Participant’s Works (in electronic form and hard copy) to participate in the Project, the Participant and/or persons stipulated by the clause 2.2 of the Regulation irrevocably acknowledge and agree with the conditions for organizng and implementing the Project set forth by this Regulation.

**Legitimate Representative (article 242 of the Civil Code of Ukraine):

1. Parents (adoptive parents) are Legitimate Representatives of their young children and minors.

2. Guardian is a Legitimate Representative of minor and disabled persons.

3. In cases stipulated by the Law, other person may act as a Legitimate Representative.

3. PROCEDURE FOR SUBMITTING THE APPLICATIONS

AND SUBMITTING (SENDING) THE WORKS

3.1. The deadline for submitting the Applications (application forms, e-mails) and the Works to participate in the Project shall be defined by the Organizing Committee with the approval of the Organizer and shall be published by the Organizing Committee on the Organizer’s online resources and/or other advertising/information materials on the Project prior to its commencement.

3.2. In order to participate in the Project, the Participants shall register (and/or be registered by the persons stipulated by the clause 2.2 of this Regulation) on the Project website or online resource by filling in the suggested Application form (application form, e-mail), and they shall also attach high-quality scanned copy, photo and/or electronic form of the Work according to the provisions/requirements of the section 2 of this Regulation.

3.3. The following information shall be filled in in the Application form (application form, e-mail) to participate in the Project:

– full name of the Participant or persons stipulated by the clause 2.2 of this Regulation, in case of their involvement in the registration of the Participant;

– date of birth and age of the Participant;

  • country and place of residence of the Participant;

– contact details including phone number and e-mail address;

– there can also be data on the educational institution (Teacher/Mentor – Supervisor of the Work) where the Participant studies (optionally), etc.

– suggestions and other information.

3.4. In order to participate in the Project, the Participant may submit only 1 (one) Work.

3.5. Requirements to the Work:

– the Work shall correspond to the topic of the Project defined by the Organizing Committee and it can be performed using any technique;

– the Work shall be an original work of art saved on any of the following media/formats: drawing, painting, and it shall be performed personally by the Participant;

– bending and folding of the Works shall not be allowed;

– the Work shall be painted on canvas or paper of А3 format; other formats (sizes) are also allowed, but not less than А4 format and not more than А1 format;

– the Work shall be uploaded during the registration in digital format with high resolution (300 dpi), in one of the following types of file: .jpg or .png;

– it shall have minimum resolution of 2,400 pixels x 2,400 pixels;

– maximum file size shall not exceed 10 MB

– it shall not contain any copyrighted material;

– it shall not contain any abusive (including illegal) material (content/context) and/or the one which infringes the provisions of the acting legislation of Ukraine;

– it shall fully comply with this Provision, particularly with respect to the procedure for the implementation of the Project.

4. PROCEDURE FOR SENDING AND RECEIVING WELCOME LETTERS

4.1. Upon completion of the registration stage and complying with the conditions of the Project, every Participant will receive welcome letter on his/her birthday with a drawing drawn by the other Participant of the Project sent to his/her email that was mentioned during the registration.

4.2. The deadline for sending welcome letter shall be defined by the Organizing Committee with the approval of the Organizer, and it shall be published by the Organizing Committee on online resources of the Organizer and/or in other advertising/information materials on the Project prior to its commencement.

5. GROUNDS FOR DISQUALIFICATION OF THE PARTICIPANTS

5.1. The grounds for disqualification of the Participants are stipulated by this Regulation (including non-compliance of the Work with the established requirement, infringement of the provisions of the acting legislation of Ukraine and other justified cases), this section and the acting legislation of Ukraine.

5.2. Any infringement of the procedure for the registration of the Participant to take part in the Project, stipulated by this Regulation, may serve as grounds for further disqualification of this Participant by the decision of the Organizing Committee.

If the Organizing Committee/Organizer finds the absence of any consent from the Legitimate Representatives of the Participant, stipulated by the section 2 of this Regulation, this Participant shall be disqualified.

5.3. The Works (their content/context) sent by the Participants in electronic form and/or hard copy, which infringe the acting legislation of Ukraine and/or this Regulation, particularly with respect to the procedure for the implementation of the Project, shall be disqualified.

5.4. The Participants, whose Works (content/context) in electronic form and/or hard copy contain (depict) any obscenity or unacceptable graphic image, which violates human and civil rights and freedoms as well as rights and freedoms of the State of Ukraine, or otherwise infringes personal or proprietary rights of any of the third parties, shall be disqualified.

5.5. Illegible or corrupted scanned copies, photo, electronic versions (including of poor quality) of the Works of the Project Participants shall not be accepted.

6. OTHER ORGANIZATIONAL ISSUES

6.1. This Regulation was published in the Internet on the website of the Organizer: https://noospherespace.art/

The Organizer reserves the right, at any time, to amend this Regulation without prior and/or further notice to the Participants of the amendments.

6.2. The information about the Project shall be disseminated (published) on behalf of the Organizer:

– on the Internet resources (official website and official pages in social networks as well as on other Internet platforms;

– in educational institutions of Ukraine and the world of the appropriate age group of potential Participants;

– in artistic educational institutions (schools, studios, workshops, etc.) of Ukraine and the world;

– by other means, in compliance with the acting legislation of Ukraine.

6.3. The Organizer shall be liable in accordance with the acting legislation of Ukraine, except under this Regulation, cases of abuse by the persons stipulated by the clause 2.2 of the Regulation (section 2 of the Regulation) and/or providing untrue/false information (including with respect to the obtained consent of the Legitimate Representatives of the Participants) during the registration of the Participant, force-majeure, the Participant’s and Organizer’s/Organizing Committee hardware or software errors, faults (including unavailability) in computer equipment, Internet, servers, providers, etc.

6.4. Submitting/Sending the Works (in electronic form and/or hard copy) by the Participant to the Organizer’s address as a part of the Project shall constitute a confirmation of voluntary and free transfer of exclusive proprietary copyrights to the Work of this Participant (work of visual art of the Participant) as intellectual property object to the Organizer.

6.5. The Project is funded by of NGO “ASSOCIATION NOOSPHERE” at its own expense and by funds raised (including, but not limited to, charitable contributions) from legal entities and/or individuals according to the procedure stipulated by the acting legislation of Ukraine.

6.6. The Organizer shall be entitled to attract sponsors (individuals, individual entrepreneurs, and legal entities) as well as partners in other forms of cooperation to the organization, announcement, implementation and funding of the Project.

6.9. By registering and participating in the Project, the Participant and/or Legitimate Representatives of this Participant agree to the terms and conditions of the Privacy Policy and Terms of Use of the Project website, published on the Organizer’s website at the following link: https://noospherespace.art/.

6.10. The authorized representatives of the Organizing Committee shall provide clarifications and advices on the implementation of the Project. The Organizing Committee shall mention its contact details on the Organizer’s online resources and/or other advertising/information materials on the Project prior to its commencement.
